Haldiram Bhujiawala owner's bail plea rejected by the Calcutta High Court

Haldiram Bhujiawala owner Prabhu Shankar Agarwal’s bail plea was rejected by the Calcutta High court on Thursday. Prabhu Shankar Agarwal was accused of conspiring to the murder of a small tea stall owner and hence was sentenced to life imprisonment by a fast track court on 29th of January this year. The tea stall of the victim fell on the way of the food plaza which the accused was planning to construct and so conspired for the inhuman action.

The bail plea was rejected by Justice S P Talukdar and Justice M K Sinha, members of the Division Bench.

Mr. Bikash Bhattacharya, the lawyer of Prabhu Shankar Agarwal claimed that the land that was acquired by the tea seller actually belonged to Mr. Agarwal who was planning to construct the food plaza in the Burrabazar district. Thus according to him it was more of the nature of civil dispute.

However, the public prosecutor, Mr. Asimesh Goswami easily put down Mr. Bhattacharya’s point of civil dispute issue.

Prabhu Shankar Agarwal, Gopal Tiwari, Arun Khandelwal, Manoj Sharma and Raju Sonkar were sentenced to 10 years of imprisonment under section 307/34 (attempt to murder/common intention). Also they have been charged under Section 120 B (criminal conspiracy) by the Bankshall Court judge, Tapan Sen.

The gun firing was actually done by Gopal Tiwari.  So as per Arms Act, he was sentenced to seven years of imprisonment under one section and three years under another section.
