Nearly one and half month after the pronouncement of the Ayodhya verdict by the Allahabad High Court, the Sunni Central Wakf Board filed a petition challenging the decision of the three judge’s bench in the Babri masjid title suit in the apex court on Tuesday.
Wakf Board lawyer Zafaryab Jilani confirmed the news by saying that their appeal on behalf of Sunni Wakf Board was filed today. He further put forward that board’s plea to the court was that the ‘building in dispute is a mosque and its possession be delivered to Muslims’.
Calling the earlier verdict biased and based on faith rather than documentary evidence, board lawyer said that petition also argues that the verdict violates Articles 25 and 26 which gives equal rights to all faith. The appeal has the endorsement of the All India Muslim Personal Law Board.
On September 30, the three judge bench comprising – Justice S U Khan, Justice Sudhir Agrawal and Justice D V Sharma decided to divide 13,450 sq-ft of disputed plot in Ayodhya into three equal parts among the three main petitioners- the Uttar Pradesh Sunni Central Waqf Board, Nirmohi Akhara and Ram Lalla Virajman (idol of baby Ram).
The high court bench, in a majority ruling, had said the disputed site was indeed the birthplace of Hindu god Ram and the Babri mosque was built after razing a temple at the spot.
However, on December 11, the Lucknow Bench of the Allahabad high court extended the stay on implementation of its verdict on the Babri Masjid-Ramjanmabhoomi title suit by 45 days till February 15, 2011.
